Conflict or Corruption?


In 1989 Richard Jones was hired to be Whittier's contractor attorney.  He is also the Chairman of the Board of Cal Domestic Water (a position he has held continuously since 1995) a privately held water company that Whittier sell some of its water leases to (up to 6000 acre feet or 1.5 Billion gallons a year).  Some of that water is sold back to other parts of Whittier where its blend with other suppliers.  It is also sold to other neighboring Cities that Mr. Jones or others employed by Cal Domestic Water contract with.

His water company would have been one of the water suppliers to a controversial oil project which recently the Appellate Court ruled the lease between the City and oil companies was illegal and terminated it which killed the oil project.   Mr. Jones is also one of the litigating attorneys for the City of Whittier in that case.

According to the Whittier Municipal code 600 & 608 Mr. Jones is considered an "Officer of the City" which prevents him from doing business with the City of Whittier directly or indirectly.  Mr. Jones improprieties with water spreads across four Cities and two counties (Los Angeles and Orange).

Whittier's Municipal code 600 and 608 state;


SECTION 600. - Officers To Be Appointed by the City Council.

In addition to the city manager, there shall be a city attorney who shall be appointed by and serve at the pleasure of the city council.

SECTION 608. - Illegal Contracts; Financial Interest

No member of the city council, department head or other officer of the city (except a member of any board or commission), shall be financially interested, directly or indirectly, in any contract, sale or transaction to which the city is a party.

On the right is a list of transactions as recorded by the City of Whittier with Cal Domestic Water since 1997.  The request was done from January 1, 1976 to November 14, 2014.  Its clear Whittier did not start doing business with Cal Domestic Water until they hired Jones (1989) who is also the Chairman of the Board of Cal Domestic Water and has been since 1995.

1993 Richard Jones becomes a Board Member of Cal Domestic Water  (He has served as Chairman of the Board at CDWC since 1995 and has served as a Director since 1993) - Click here

 

Mr. Jones does not disclose on his 700 forms until 2005 that he is Chairman of the Board of Cal Domestic Water.  12 years after he had a position on the Board of CDWC.  Look at the forms and you will see.

 

 Whittier and Cal Domestic Water pumping facilities that are located close together.  In 1997 an agreement was signed between Whittier and CDWC to installed a metered pipeline between the two facilities for passing water from Cal Domestic Water to Whittier. 

I suspect it has been used to pass water from Whittier to Cal Domestic Water since Whittier is selling some of its water lease rights to Cal Domestic Water (326 million gallons annually).  To see the agreement and page 6 where Richard Jones had signed for approving the the form even though he was Chairman of Cal Domestic Water at the time - Click here

On October 31, 2005 Cal Domestic Water Company entered into an Easement agreement with the City of Whittier.  The lawfirm that review those documents was Mr. Jones firm that was under contract with the City of Whittier as its contractor attorney.  The conflict is its Mr. Jones law firm and Water Company that is involved.  Click here to see the easement document.  Go to page 6 where the signatures are.

Water Leases between Cal Domestic Water and the

City of Whittier


 

On July 1, 2009 Whittier starter leasing 4,000 acre feet of water to Cal Domestic Water or 13 million gallons of water.  An acre foot is 326,000 gallons of water.  Multiply that by 4,000 you get 1,304,000,000 of water.

 

 

In 2012 the City of Whittier signs a four year contract with Cal Domestic Water for the sale of Whittier's water leases up to 6000 acre feet or approximately 1.5 Billion gallons of water.

 

 On February 25, 1997 Cal Domestic Water and the City of Whittier built a metered pipeline (Interconnection) between Cal Domestic Water and Whittier facilityies  If you look at page 9 of the document on the right you will see that Mr. Jones who at that time was the attorney for the City of Whittier and the Chairman of Cal Domestic Water sign off for the City AS TO APPROVE FORM.  I believe this to be a conflict since he was working for both parties.

 February 25, 1997 agreement between Cal Domestic Water to connect there facilities with a metered pipeline.  Page 9 of this document show that Mr. Jones signed and approved the document for the City.  Problem is he was working for both the City of Whittier and Cal Domestic Water at the same time.  Click here to see document.

 

 


Whittier Oil Project, Cal Domestic Water would be a

Water Supplier


 

In 2006 Whittier started the meeting with Matrix Oil.  A small oil company based in Santa Barbra.  In May of 2005 there was a fire at a facilitied owned by Matrix Oil in Whittier called Honolulu Terrace.  In that fire one man had lost his life and the other was badly injured.

As shown in the FEIR for the oil project Mr. Jones water company Cal Domestic Water was called out as one of the water suppliers for the project.  Mr. Jones was also the lead attorney for Whittier on that project.

 Jones and his Involvement with the

Cities of La Habra, Brea and Fullerton


 

 Richard Jones is also the contractor attorney for the Cities of Whittier, La Habra, Fullerton and Westminster.  What is unusal about all of this is of the four Cities that almost border themselves his company Cal Domestic Water is providing water too.  In the City of Brea which is in this chain James Markman who is lead council to Cal Domestic Water is also a water supplier to Brea.

 

 

Jones is the City Attorney to La Habra.  La Habra has a seat on the Board of Cal Domestic Water along with voting rights.

James Markman who is the Special Council for Cal Domestic Water and an attorney for Whittier is also the City Attorney for the City of Brea.

What do they all have in common?  They all work for Cal Domestic Water, they are contractor attorneys for these Cities and Cal Domestic Water sell water to these Cities.

Brea City Manager sits on Board of Cal Domestic Water.  La Habra and Brea own Stock in Cal Domestic Water.
